Florida Child Support

Under Florida Law, all parents have a legal duty to support their biological and adopted children. Child support issues can arise not only in divorce cases, but also in paternity, domestic violence, and modification cases. Chapter 61, Florida Statutes, contains child support guidelines. The guidelines establish base child support amounts, depending upon the number of children and the parties’ after tax incomes. Income and the number of children are not the only factors which must be considered in determining the appropriate amount of child support in a particular case. Additional amounts may be added based upon childcare and health insurance costs, and other factors. The number of overnights that the children spend with each parent will also affect the amount of child support to be paid. 

Another factor is whether either parent is voluntarily unemployed or underemployed. This is a particularly important factor in Florida’s current economy, where many people have lost their jobs and are either unemployed or earning less than they did before the recession. The Florida courts determine whether a parent is voluntarily unemployed or underemployed. If the court determines that a parent could be working or earning more money but they have chosen not to, income can be imputed for them for child support purposes. This means that they could be paying more support than the guidelines indicate for someone with their actual annual income.
